Everything you need to know about Permitted Development in 2025
If you’re considering adding a garden room to your home, you’ll be pleased to know that the majority of our garden rooms fall under permitted development rights. This means they typically don’t require planning permission or need to comply with local building regulations, saving you time, effort, and cost.
To help you understand what’s covered under permitted development, here’s a quick guide to the rules and what they mean for your garden room project:
The basics of permitted development
- Up to 15 m2 internal floor area:
You can build a garden room with an internal floor area of up to 15 m2 right up to your property boundary, as long as the height doesn’t exceed 2.5 metres above the adjacent ground level. This is especially useful if your garden slopes. - 15-30 m2 internal floor area:
If your garden room is larger (between 15-30 m2), you won’t need building regulations approval, provided that:- It’s at least 1 metre from any boundary, OR
- It’s constructed using substantially non-combustible materials.
(Note: These buildings cannot include sleeping accommodation.)
- Positioned 2+ metres from the boundary:
For garden rooms that are located 2 metres or more from the boundary, you can still build up to 30 m2 of internal floor area. Plus, the height limits increase:- Flat roof: Up to 3 metres at the highest point.
- Pitched roof: Up to 4 metres at the ridge, with 2.5 metres to the lowest eaves.
- Over 30 m2 internal floor area:
If your garden room exceeds 30 m2, you’ll need to follow the local building regulations process.
Important considerations
- Conservation areas or areas of outstanding natural beauty:
If you live in a designated area, additional restrictions may apply. It’s always a good idea to check with your local authority before starting your project. - Total curtilage limits:
Permitted development allows you to use up to 50% of the land surrounding your property for outbuildings, including garden rooms. - Responsibility for compliance:
While we build to comply with permitted development guidelines, it’s ultimately the customer’s responsibility to ensure their project meets the necessary requirements.
